Parental/Guardian Form for a Child under 18
 
RELEASE/INDEMNIFICATION/DEFENSE AGREEMENT
 
I, the lawful parent or guardian of child (children) listed above, which as used below shall include any and all of my aforementioned children participating in the below event and activities), on behalf of myself and my child, irrevocably release from all liability to the fullest extent permitted by the law, and hereby agree to indemnify, defend and hold harmless the Roman Catholic Bishop of Worcester, a corporation sole, its officers, agents, representatives, volunteers, chaperones, clergy, religious and employees of the Diocese of Worcester and any and all parishes and ministries thereof (collectively, "RCB"), from and against any and all liability, demands, actions, causes of action, claims, judgments, cost and expense, including but not limited to attorneys' fees, known or unknown at this time, arising out of or in any way related to any injury, illness, loss or other damage to person or property incurred: (a) by my child and/or myself while participating in or traveling to or from, or in any way arising out of, the following event or activity: St. Bernard’s Summer Education 2024-2025 and/or (b) by any other person sustaining or alleged to have sustained any injury, illness, loss or expense, including attorneys’ fees, by reason of my child’s or my negligent or wrongful act or omission. 
 
The RCB’s right to defense at my expense shall accrue immediately upon the utterance of any and all claims or complaints arising out of, based upon or in any way associated with the activity or event, regardless of other claims simultaneously brought, and shall not be contingent upon the merit of any such claim(s) or any question(s) of fact raised by the claim or complaint. 
 
I agree to instruct my child to cooperate with and follow the rules of the event or activity referenced above and any instructions of the RCB. In the event my child does not cooperate with or follow same I agree that my child shall withdraw from the event or activity referenced above and that I shall, at my sole cost and expense, arrange for the immediate transportation of my child from the event or activity referenced above to my home, if so requested by RCB.
 
Additionally:

• I appoint RCB as my lawful attorney-in-fact, to act for me in my name and stead and on my behalf, in any way that I would, in the reasonable and sole judgment of RCB be expected to act if I were personally present, with respect to the following matters if any injury, illness or medical emergency occurs during the activity:
• To give any and all consents and authorizations to any physician, dentist, hospital or other persons or institutions pertaining to any emergency medications, medical or dental treatments, diagnostic or surgical procedures or any other first aid and/or emergency actions as our attorney-in-fact shall deem necessary or appropriate for the best interest of my child. 
• The release/indemnification/defense provisions above shall apply to any such decision or action.
• I understand that RCB through its agents will make a reasonable attempt to contact me as soon as reasonably possible in the event of medical emergency involving my child.
• The powers and authority granted herein may be revoked prospectively by written notice delivered in-hand to RCB, provided that in such notice I confirm that I am immediately assuming full responsibility for all decisions and actions as to my child’s welfare and health. Absent receipt of such written notice this power of attorney shall not be affected by my disability, incapacity or adjudicated incompetence.
• This power of attorney shall lapse automatically upon completion of the activity listed above that my child is participating in or attending and related activities, and travel if any, and the return of my child to me or my designee.  Any revocation of such powers and authority shall not affect any other provision of this Release/Indemnification/Defense Agreement, each of which shall continue in full force and effect.
• I understand and agree that RCB is not and shall not be responsible for assuring that my child takes any medication, prescription or otherwise, which may be indicated for my child.  There are no medical conditions, nor any life threatening allergies to foods or medicines, that would limit my child’s full participation in the activity or require any special precautions except those I listed above.
• I have listed above any current medications and dosage (prescription and over-the-counter) that the RCB might need to know about should an emergency arise.
• If any change occurs in the information which I have provided with respect to emergency contacts or medical information I shall provide immediate written notification of such change to the RCB.

 
As evidenced by my clicking below, RCB and/or an agent thereof may use my child’s portrait or photograph for promotional purposes related to the advancement and development of the ministry of the Roman Catholic Church and the Diocese of Worcester, and I hereby release, indemnify and agree to defend under the provisions above the RCB and its agents from any and all liability, loss, damage and expense, including attorneys’ fees, resulting from such use.  
 
By clicking below, I verify that I have carefully read and understand this statement and that I am clicking it freely and voluntarily in consideration of the RCB’s agreement to allow my child to participate in this voluntary activity, trip or event, and as an inducement to the RCB to permit such participation, without which it would not do so.  I request that my child be allowed to participate in the above-referenced activity, trip or event.

ACUERDO DE EXENCIÓN/INDEMNIZACIÓN/DEFENSA
Yo, el padre o tutor legal del niño (niños) mencionados anteriormente, lo cual incluirá a cualquiera y a todos mis mencionados hijos que participen en el evento y actividades descritos a continuación, en nombre propio y de mi hijo, irrevocablemente eximo de toda responsabilidad en la mayor medida permitida por la ley, y por la presente acuerdo en indemnizar, defender y mantener indemne al Obispo Católico Romano de Worcester, una corporación única, sus oficiales, agentes, representantes, voluntarios, acompañantes, clérigos, religiosos y empleados de la Diócesis de Worcester y a todas las parroquias y ministerios de la misma (colectivamente, "RCB"), de y contra cualquier y toda responsabilidad, demandas, acciones, causas de acción, reclamaciones, juicios, costos y gastos, incluidos, entre otros, honorarios de abogados, conocidos o desconocidos en este momento, que surjan o estén de alguna manera relacionados con cualquier lesión, enfermedad, pérdida u otro daño a la persona o propiedad incurrido: (a) por mi hijo y/o por mí mientras participa en o viaja hacia o desde, o de alguna manera surgiendo de, el siguiente evento o actividad: Educación de Verano de St. Bernard 2024-2025 y/o (b) por cualquier otra persona que sufra o se alegue que haya sufrido cualquier lesión, enfermedad, pérdida o gasto, incluidos honorarios de abogados, debido al acto u omisión negligente o ilícito de mi hijo o mío.
El derecho del RCB a la defensa a mi cargo se acumulará inmediatamente al pronunciarse cualquier y toda reclamación o queja que surja de, se base en o esté de alguna manera asociada con la actividad o evento, independientemente de otras reclamaciones presentadas simultáneamente, y no dependerá del mérito de ninguna de esas reclamaciones o de cualquier cuestión de hecho planteada por la reclamación o queja.
Estoy de acuerdo en instruir a mi hijo para que coopere con y siga las reglas del evento o actividad mencionado anteriormente y cualquier instrucción del RCB. En caso de que mi hijo no coopere con o siga las mismas, acepto que mi hijo se retirará del evento o actividad mencionado anteriormente y que, a mi exclusivo costo y cargo, organizaré el transporte inmediato de mi hijo desde el evento o actividad mencionado anteriormente hasta mi casa, si así lo solicita el RCB.
Adicionalmente:Nombraré al RCB como mi apoderado legítimo, para actuar en mi nombre y en mi lugar y en mi nombre, de la manera en que yo lo haría, en el juicio razonable y exclusivo del RCB, si estuviera presente personalmente, con respecto a los siguientes asuntos si ocurre alguna lesión, enfermedad o emergencia médica durante la actividad:Para dar cualquier y todas las autorizaciones y consentimientos a cualquier médico, dentista, hospital u otras personas o instituciones con respecto a cualquier medicamento de emergencia, tratamientos médicos o dentales, procedimientos diagnósticos o quirúrgicos o cualquier otro primer auxilio y/o acciones de emergencia que nuestro apoderado considere necesario o apropiado para el mejor interés de mi hijo.Las disposiciones de exención/indemnización/defensa anteriores se aplicarán a cualquier decisión o acción de este tipo.Entiendo que el RCB, a través de sus agentes, hará un intento razonable de contactarme tan pronto como sea razonablemente posible en caso de emergencia médica que involucre a mi hijo.Los poderes y la autoridad otorgados en este documento pueden ser revocados prospectivamente mediante notificación por escrito entregada en mano al RCB, siempre que en dicha notificación confirme que asumo inmediatamente la plena responsabilidad por todas las decisiones y acciones relacionadas con el bienestar y la salud de mi hijo. A falta de recibir dicha notificación por escrito, este poder notarial no se verá afectado por mi discapacidad, incapacidad o incompetencia judicial.Este poder notarial se extinguirá automáticamente al completar la actividad mencionada anteriormente en la que mi hijo está participando o asistiendo y actividades relacionadas, y el regreso de mi hijo a mí o a mi designado. Cualquier revocación de tales poderes y autoridad no afectará ninguna otra disposición de este Acuerdo de Exención/Indemnización/Defensa, cada una de las cuales continuará en plena vigencia y efecto.Entiendo y acepto que el RCB no es y no será responsable de asegurar que mi hijo tome cualquier medicamento, con receta o de otro tipo, que pueda estar indicado para mi hijo. No hay condiciones médicas, ni alergias alimentarias o medicamentosas que amenacen la vida, que limiten la plena participación de mi hijo en la actividad o que requieran precauciones especiales, excepto aquellas que he mencionado anteriormente.He mencionado anteriormente cualquier medicamento y dosis actual (con receta y de venta libre) que el RCB podría necesitar saber en caso de que surja una emergencia.Si ocurre algún cambio en la información que he proporcionado con respecto a contactos de emergencia o información médica, proporcionaré notificación escrita inmediata de dicho cambio al RCB.
Al hacer clic a continuación, el RCB y/o un agente del mismo pueden usar el retrato o fotografía de mi hijo con fines promocionales relacionados con el avance y desarrollo del ministerio de la Iglesia Católica Romana y la Diócesis de Worcester, y por la presente libero, indemnizo y acepto defender según las disposiciones anteriores al RCB y sus agentes de cualquier y toda responsabilidad, pérdida, daño y gasto, incluidos honorarios de abogados, que resulten de dicho uso.
Al hacer clic a continuación, verifico que he leído detenidamente y entiendo esta declaración y que la estoy aceptando libre y voluntariamente en consideración al acuerdo del RCB de permitir que mi hijo participe en esta actividad, viaje o evento voluntario, y como un incentivo para que el RCB permita tal participación, sin lo cual no lo haría. Solicito que se permita a mi hijo participar en la actividad, viaje o evento mencionado anteriormente.
